Please read these Official Rules carefully. By participating in the campaign described herein, you agree to be bound by the Official Rules stipulated herein and all terms and conditions incorporated by reference. If you do not agree to all terms of these Official Rules, do not participate in this campaign. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning.
The “Campaign” means the promotion contest regarding the Track by the artist Alan Walker, as described herein.
The “Company” means MER Recordings AS, with business address Øvre Slottsgate 2B, 0157 Oslo, Norway, and with business registration number NO 913 521 099 MVA.
An “Entry” or “Entries” means a video made by a Participant for the Campaign that is, or shall be, uploaded to YouTube, in accordance with the Official
The “Official Rules” means the terms and conditions stated in these Official Rules as stipulated herein.
The “Track” means the track “Believers” by the artist Alan Walker.
The “Participant” means a participant that has contributed, or shall contribute, with an Entry in the Campaign.
The Participant shall, before submitting an Entry and during the Campaign, meet the following criteria:
1. To have accepted these Official Rules;
2. To be a legal resident of the World (collectively, the “Campaign Territory”);
3. To be eighteen (18) years of age or older (all under the age of majority in their jurisdiction of residence as of the first day of the Entry Period must have a parent or guardian’s permission to participate);
4. To not be employed by Company or any of its affiliates or partners, or related to anyone employed by the Company;
5. To have a valid, lawful, active, and personal YouTube account (a “YouTube Account”);
6. To have a valid, lawful, active, and personal e-mail address; and
7. To not have been previously terminated from participation in the Campaign.
An Entry needs to meet the following criteria:
1. Be a video containing in-game footage from any first-person shooter video game;
2. contain the Track;
3. comply with any and all end user license agreements entered into by you and/or relevant terms and conditions set by the publishers of the video game; and
4. have a minimum running time of ten (10) seconds.
Furthermore, to participate in the Campaign the Participant needs to submit the Entry by uploading the Entry to the Participant’s YouTube Account using the hashtag #believersmontage and submitting the link to the campaign website (walkergaming.com/themontage) The Campaign is only open to legal residents of the Campaign Territory.
The winners will receive the following prizes:
The 1st prize has a combined approximate retail value (ARV) of USD 7.000, –
The 2nd prize has a combined approximate retail value (ARV) of USD 160, –
The ARV of the prizes represents Company’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prizes turns out to be less
than the stated ARV, the difference will not be awarded in cash. Prizes are non-transferable. No substitutions or cash redemptions provided that the Company reserves the right to substitute the prizes in whole or in part for a prize of equal or greater value in the event that
any component of the prizes is unavailable for any reason. Prizes may not be sold, bartered or transferred. Prizes do not include any additional expenses, including, but not limited to incidentals, meals, telephone charges, travel insurance, souvenirs, transportation, federal, state and local sales or other taxes and surcharges which are the sole responsibility of each winner.
The Campaign will be open for Entries from Friday May 14 th 09:00 CET, 2021 until Friday June 4 th , 2021 at 23:00 CET (the “Entry Period”).
Beginning on or around June 5 th , 2021, Alan Walker and Company employees will select the winners (as specified above), at their sole discretion, by judging all the Entries on the basis of he following criteria (collectively, the “Criteria”): effort (1/3), creativity (1/3) and innovation (1/3). The winner shall be the Participant with the highest overall score. In the event of tie between or among Entries, an additional judge will re-evaluate the tied Entries by applying
the Criteria to select the winner. The winner will be contacted through e-mail and presented on Alan Walker’s Instagram account. The Company reserves the right to modify or extend the Entry Period or not to award any or all prizes in the event an insufficient number of
eligible Entries meeting the minimal judging Criteria are received during the Entry Period or for any other reason, as determined by Company in its sole discretion. The Winner must be at least eighteen (18) years of age as of the first day of the Entry Period. The winner will be required to sign, have notarized, and return an Affidavit of Eligibility and Liability/Publicity Release within four (4) calendar days of Prize notification. If any winner is younger than the age of majority in his/her state or province of residence as of the first day of the Entry Period, then such individual’s parent or legal guardian must provide written permission allowing the individual to accept the Prize and the Affidavit of Eligibility and Liability/Publicity Release must be signed and submitted by a parent or legal guardian. If any winner rejects his/her Prize or in the event of noncompliance with these Official Rules and requirements, such prize will be forfeited, and an alternate winner may be selected from all remaining eligible Entries.
Upon any Prize forfeiture, no compensation will be given.
Any and all taxes, and any other costs, in connection with the Campaign, an Entry or the Participant, are borne by the Participant.
Telephone, internet, network and data charges will apply (there is no additional charge to enter this Campaign) and you must have the bill payer’s permission prior to entering the Campaign or submit an Entry.
The Participant warrants and ensures that he or she either is the sole copyright owner of the Entry or, if the copyright to the Entry is jointly owned with others, that he or she has obtained prior, written consent of any other copyright owner(s), that grant(s) the Company all of the rights set forth herein and subjects the other copyright owners to all of the obligations set forth herein. The Participant warrant and represent that their Entry is their own, unpublished, fully original creations, and that their Entry will not be libelous, infringe or violate the rights of any third parties, including, but not limited to copyrights, trademarks, or rights of publicity/privacy, or be in any way contrary to law. Furthermore, the Participant warrants that its Entries does not and shall not contain any material that; (i) impersonates any person or entity, or falsely states or otherwise misrepresents the Participants affiliation with a person or entity, without such person or
entity’s prior written consent; (ii) constitutes personally identifying information or other personal or identifying information about any individual, without prior consent; (iii) is false, deceptive, misleading, scandalous, indecent, criminally obscene, pornographic, unlawful,
blasphemous, defamatory, libelous, fraudulent, tortuous, threatening, harassing, hateful, degrading, intimidating, or racially or ethnically offensive, or contains nudity, pornographic images, explicit sexual themes or graphic violence; (iv) encourages conduct that could be
considered a criminal offense, could give rise to criminal civil liability, or could violate any law, or that could otherwise be considered inappropriate; (v) constitute a virus, worm, Trojan horse, Easter egg, time bomb, spyware, or other computer code, file or program that is
harmful or invasive or may, or is intended to damage or hijack the operation of, or to monitor the use of, the Company or any of their hardware, software, or equipment; (vi) constitutes any advertising, promotional material, or other form of solicitation; (vii) constitutes any non-public information about a company; or (viii) violates any other applicable terms and conditions stipulated by third parties (e.g. YouTube). By submitting the Entry, Participant warrants and represents that (a) he/she expressly agrees to all terms set forth in these Official Rules; (b) he/she provides his/her express permission
(and if applicable, has his/her parent/legal guardian’s permission) to appear in the Entry as described herein; and (c) he/she is aware of and expressly consents to the use and/or display of the Entry on social media. Each Participant acknowledges that YouTube, or and any other third party, is not in any way, shape or form associated with the Campaign nor affiliated with the Campaign, nor a sponsor thereof. The Participant and the Entry must comply with all related third-party Terms of Services, and Community Guidelines.
The Participant is responsible for making sure that their Entries complies with all applicable federal, state and local laws, rules, regulations, and sanctions. By participating in this Campaign and/or submitting an Entry, each Participant agrees to indemnify and hold the Company and their respective subsidiaries, affiliates, partners, dealers, promotions agencies, partners, representatives, agents, successors, assigns, employees, officers and directors and any parties affiliated with the Company or involved in the Campaign (“Released
Parties”), harmless from any liability, loss or damage they may suffer as a result of claims, demands, costs or judgments against them arising out of the activities to be carried out pursuant to these Official Rules, including, but not limited to, the content of the Participant’s
Entry. The Company shall not be liable for any claims, actions, injury, loss or damage of any kind, pursuant to the Campaign or these Official Rules. Furthermore, by participating in this Campaign and/or submitting an Entry, each Participant agrees to indemnify and hold
harmless the Released Parties from and against any third-party claim arising from use of the Entry. Each Participant hereby represents and warrants that he/she is at least eighteen (18) years of age as of the first day of the Entry Period and, if any Participant is under the age of
majority in his/her jurisdiction of residence as of the first day of the Entry Period, that he/she has the express permission of his/her parent or legal guardian to participate in this Campaign as contemplated herein. By participating in the Campaign, the Participant approve that the Participant’s personal data is stored electronically in accordance with the Swedish Person Data Act (1998:204), and that the personal data may be published by the Company.
The Company reserves the right to exclude and suspend Participants from the Campaign and deny a Participants any winning, should such Participant not comply with all Official Rules as stipulated herein or attempt to interfere with this Campaign in any way. Company reserves the right not to award any or all prizes, or to cancel, terminate, modify, extend or suspend this Campaign without liability in the event an insufficient number of eligible Entries are received. Company reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Campaign should it determine (in its sole discretion) that a virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Campaign. In such case, Company will select the winner from all eligible Entries received prior to and/or after (if appropriate) the action taken by Company. Company reserves the right, in its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Campaign or website.
Any potential winner may be requested to provide Company with proof that such winner is the Authorized Account Holder of the social media account associated with the winning Entry. Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability,
unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of Entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Campaign, including any injury or damage to Participant’s or any other person’s computer relating to or resulting from participating in this Campaign or downloading any materials in this Campaign. Company may
prohibit a Participant from participating in the Campaign or winning a prize if, in its sole discretion, it determines that said Participant is attempting to undermine the legitimate operation of the Campaign by cheating, hacking, deception, or other unfair playing practices
(including the use of automated quick entry programs), using multiple accounts to enter or intending to annoy, abuse, threaten or harass any other Participants or Company’s representatives.
CAUTION: ANY ATTEMPT BY AN PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CAMPAIGN MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The Company and its licensees, affiliates and assignees reserve the right to cancel the Campaign or amend these Official Rules without notice in the event of circumstances outside its/their control, including without limitation, a major catastrophe, war, civil or military disturbance, strike, earthquake or any actual, anticipated or alleged breach of any applicable law or regulation or any other similar event. No liability shall be attached to the Released Parties as a result thereof. Released Parties are not responsible if the Campaign cannot take place or if any prize cannot be awarded including, but not limited to, due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
This Agreement shall be construed and interpreted in accordance with the laws of Norway and all disputes arising in connection with this Agreement shall be settled by the Stockholm District Court as
the court of first instance.
All personal data that is obtained by the Company, its licensees, its subsidiaries or its partners, under the Campaign, will be handled in accordance with the Norwegian Data Protection Act and our privacy
